General Terms and Conditions of Sale Applicable to Sellers

1. Purpose
This General Terms and Conditions of Sale (GTCS) define the terms under which professional sellers may market their products via the MonBoli.com platform.

The platform operates in two distinct sales formats:

— time-limited flash sales featured on the homepage,

— a permanent catalog accessible at all times by users.

2. Registration and Eligibility

Access to the seller space is restricted to professional merchants with a valid company registration number (SIRET or equivalent) and who can provide all legally required business documentation.

Each seller must subscribe to a monthly fee of €49 incl. VAT, which is a prerequisite for publishing products, managing orders, and tracking sales.

3. Sales Type and Commissions

3.1 Flash Sales

Flash sales are event-based, time-limited campaigns (e.g. 48h, 72h) promoted on the homepage. They offer increased visibility and higher traffic.

➡ A 25% VAT-included commission is charged on each sale from these campaigns.

3.2 Permanent Catalog

Products listed in the permanent catalog are available on the platform at all times without a time restriction.

➡ A 17% VAT-included commission is charged on each sale from the permanent catalog.

4. Logistics Responsibilities

The seller is solely responsible for:

• managing inventory,
• packing and shipping orders within the stated time frame,
• handling returns and customer disputes.

MonBoli.com does not intervene in logistics and cannot be held responsible for delivery issues or after-sales service failures.

5. Seller Obligations
The seller agrees to:

• offer products compliant with applicable regulations,
• provide accurate, complete, and up-to-date product listings,
• deliver a responsive and professional customer service experience.

Any breach may lead to suspension or termination of the seller account without refund of fees paid.

6. Platform Use

Access to the seller dashboard is conditional upon timely payment of the subscription. Failure to pay will result in temporary account deactivation.

MonBoli.com reserves the right to refuse, suspend, or remove any listing that fails to meet its quality standards or editorial policy.

7. Advertising and Visibility

The platform offers two premium advertising slots, available to sellers looking to enhance brand awareness or highlight a specific offer.

The terms and pricing for these spaces are outlined in a separate agreement.

8. Données personnelles / Personal Data Protection

The seller agrees to comply with applicable personal data regulations, in particular the General Data Protection Regulation (GDPR).

The seller commits not to collect, exploit, or resell user data for unauthorized purposes.

9. Intellectual Property

All content published on MonBoli.com (texts, images, logos, descriptions) must be royalty-free or properly licensed.

The seller shall hold MonBoli.com harmless against any third-party claim related to intellectual property violations.

10. Résiliation / Termination

The seller may terminate their subscription at any time from their personal dashboard.

No refund shall be issued for a started month.

MonBoli.com reserves the right to terminate an account in case of fraud, breach of the GTCS, or damage to the platform’s reputation.

11. Acceptance of Legal Documents

The seller acknowledges having read and unconditionally accepted the following documents:

• The SEO Policy
• The Privacy Policy
